Using Cancelled weeks to vote is illegal

Further to the recent club AGM/SGM when the Club Chairman used cancelled weeks to vote, we have received the following advice . . . .

“This is totally illegal. In order to vote it is necessary to be an Owner and be up to date with payments, the Owner can Vote or delegate their Vote, but the Weeks that are from the Community and do not have an Owner cannot vote, since this generates an absolute lack of balance and democratic principle where the Owners with their majorities have decision-making capacity, which is a guiding principle of a vote.

If the President took over the representation of the unowned Community Weeks, he would always have the power of decision and not the Owners, which is why this is illegal and is not sustained in any trial or process, this AGM is Illegal Base and Null and void.”
