Are you concerned about recent letter from Mr Fletcher with demands for payments to the club?
We understand why some owners are anxious about recent demands and letter from the Club Chairman. Unfortunately Mr Fletcher's intimidating tactics and veiled threats are currently causing some concern among owners, but there is really no need to worry.
There are a number of legal appeals and challenges underway that have yet to be fully resolved, not least of which is the ruling by the court in Arona, reported last February 2020, confirming that WimPen have the right to collect maintenance fees. (See: http://www.losclaveles.eu/legal.html). We await the outcome of the club’s appeal to the Spanish Supreme court against this ruling which may take some time.
In the meantime, WimPen continue to manage the resort and manage the finances on behalf of the Community and it is from the Community account that all the running expenses are paid. The club makes no financial contribution to the resort and have failed to provide information of how they are using the funds that some owners have paid them.
Please ensure your payment goes to the Community
Payment to the Community account, which is managed by WimPen, guarantees your access to the resort and all resort facilities. You will also be contributing to the resort expenses, including wages, maintenance and other costs. Payments made to the club are NOT passed to the community so will not provide you with the services you are paying for.
