Sheriff Appeal Court upholds sheriff’s decision not to order timeshare trustee to resign
The Sheriff Appeal Court has refused an appeal by an unincorporated association operating a timeshare in Tenerife against the refusal of its action for specific implement calling for a trustee of the Club to resign after finding that the sheriff was entitled to conclude on the evidence that the defender did not intend to be bound by what its representatives said on a video call discussing the trustee’s potential removal.

Here is a brief summary of what we learned at the AGM
- Noel Ruddy replaced Keith Lear as an elected member of the Club Committee. Keith has stepped down but remains as Escritura Owners Rep. I would like to thank Keith for his invaluable contribution.
- Under the Deed of Trust, our community is obliged to indemnify the Trustees, Hutchinsons, for any legal costs they incur in relation to Los Claveles. As a result og Hutchcinsonsdefence of the dormer chairmans attempt to force their resignation, the accounts show our legal expenses for the year at over €100,000
- Rentals of blocked weeks have enabled us to recover all of the bad debts for the year. This will help Wimpen continue the refurbishment
- Owners with significant arrears of maintenance fees have now had their ownership rights cancelled, subject to a final 21 day grace period in which to pay for reinstatement.
- We are in the hands of the Town Hall with regard to music in the bar following a complaint from a neighbour. Wimpen are in discussion with them to try and resolve the problem. At least one other Ona resort is suffering the same problem.
- All DOA and Club resolution were approved.
